Study published on the lack of legal certainty for big data and AI
How can big data and AI applications be used profitably without violating data protection and IT security? Our data protection experts addressed this question in the recently published legal study "Systematic Privacy in real-life Data Processing Systems". They examined current regulations from the legal areas of data protection, IT security law and copyright law in relation to big data and also looked at the draft EU regulation on artificial intelligence (KI-VO-E).

Ihr Fazit: Der aktuelle Rechtsrahmen reicht für eine sichere Verarbeitung von Big Data nicht aus und sorgt für Verunsicherung bei Bürgerinnen und Bürgern sowie Rechtsunsicherheit bei Unternehmen. Sie fordern einen ganzheitlichen, rechtlich-technischen Rahmen und entwickeln konkrete Lösungsvorschläge sowie Handlungshilfen.
Die Studie ist im Rahmen des ATHENE-Forschungsprojekts "Systematic Privacy for large, real-life Data Processing Systems"entstanden. An der Studie sind folgende Forschende beteiligt: Prof. Dr. Gerrit Hornung, LL.M. (Edinburgh) und Till Schaller, Universität Kassel, Dr. Annika Selzer, Sandra Stummer, LL.M. und Jessica Kriegel, Fraunhofer SIT, Forschungsabteilung "IT Law & Interdisciplinary Privacy Research", Prof. Dr. Indra Spiecker genannt Döhmann, LL.M. (Georgetown University), und Amina Gutjahr, Goethe Universität Frankfurt und Prof. Dr. Thomas Wilmer, Hochschule Darmstadt.
